In December, 1880, the life estáte of Charles G. Wheeler was levied ft pon by Addison Fletcher and sold at sheriff' s sale, Fletcher getting the shenff's deed of it. Afterward's he died and Boilajul Fetcher became executor of his estáte and as sucli executor entered upon the Wheeler land and besan committinf? waste, cuttnii; down tiniber etc, and ; converting the same to Jiisown use, greatly depreciating the v;ilue of the inheritance. They want Fletejjpr restraiued from cutting anv tirnber into cord wood or logs nntil the further order of the court and that he may be decreed to keep the premises in ood condition. A pieliminary injunction was issued.
