Be it ordained by the Mayor, Recorder and Aldermen oí the city of Ann Arbor: That seetion nine of au ordinance relative to the prevention of fires, made and passed In Coinmou Coundl June 17, 1851, and amendedin Common Comicil Oetober 10,1871, and again likewlse amended September 4, 1882, and again likewise amended July 27, 1885, and seotions nine and ten o) the same ordtnanoe be and the same are hereby amended to read as follows: SeutionD. lt shal] not be lawful for any person hareafter to ereet or place any building: or part of a on any lotor part of a lot fronting on Main street between Ann street and Liberty street; nor on any lot or any part of a lot frontiag on either side of Huron street between Seeond street and Fifth street; nor on any lot or auy part of a lot on Washington street, bwtween Main street and Fifth street in this city, uuless sueh building or part of a building: shall be constructed of stoue or brick, with party orfire walls of the same material, rising at least ten inches abovo the roof, if the same be covered metal or slate, and if covered with wood, then at least twofeet. Norshall it bc lawful for any person hereafter, without permission of the Common Council, tojerect or place any building' or part of a building on any lot or part of a lot fronting oa .Main street between North street and Ann street; nor on any lot or part of a lot frontinj.' on the same etreet between Liberty street and Willfam street; nor on any lotor part of u lot fronting on Fourth street between North street and Liberty street; uor on any lot or part of a lot fronting on the west side of Fifth street between North street and Liberty street; nor on any lot or part of a lot fronting on the east side of First street between Catharkie street and William street; nor on any lot or part of a lot fronting on Seeond street between Catharine street and William street; nor on any lot or part of a lot fronting on Detroit street between Ann street and the Michigan Central railroad ; nor on any lot or part of a lot fronting on Catharine street between Seeond street and Fifth street; nor on any lot or part oí a lot fronting on Ann street between Seeond street and Fifth street; nor on any lot or puit of a lot fronting on Huron street between First streot and Second street; nor on any lot or part of a lot frontingon Washington street between First street and Main streel; nor on any lot or part of a lot f rontiug on Liberty street between First street aud Fifth street; uor on any lotor part of a lot fronting on the west side of State street between Liberty street and William street; nor on auy lot or. part of a lot fronting on the east Mk' of Mnynard street between Liberty streei and William street, unless such building or part of a building shall be construeted of stone or brick with ou ter wulls not lese than twelve üiches in thickness and with party or lire walls of the same material and thickness rising at least ten inches above the roof, if the sninp be covered with metal or slate, and if covered with wood, then at least two feet. Provided, that notliingcontained in this seetiou shall be eonstrued as prohibiting the erectiou within the limits mentioned in that clause of this seetion commeneing with the words, "Nor shall it be lawful for any person hereafter, without the jjermission of the Common Council, etc.," of any building f wood which shall not be more than eight feet square and ten feetin height from the common surl'ace of the ground to the top of the plates, with roofs not to exceed one-quarter pitch, but such small building, shall not be made to front on any street, nor be les than thirty feet from the line thereof exeept with the consent of the council (nor shall mor than one such building be allowed without such consent on any oue lot or premises oceupied ai oue tenement.) No barn, privy, hog-pen, slaughterhouse, or any other building whicn ahall be used or ocipied for any purpose liable to prove detrimental to the public health, or a nuisance to the adjoining ocoupant or to the public, shall be built fronting on any of the public streets of said city, uor witliin thirty feet from the line thereof. Skction 10. If any person shall erect any building within the limits specined in seetion nine of this ordinance, contrary to the proviBione thereof, the owner or owners, builder or builders thereof shall, on conviction of such violation, be punished by a fine not exceeding one hundred dollars and costs of prosecution, or by imprfsonment in the county jatl of Washtenaw county for a term not exeeedïng ninety in the discretion of the Justicc who shall try the offender. Such person or persons shall al6O pay a penalty of üfty dollars and costs of prosecution for each and every week sueh building: shall remain so erected af ter notice from any member of the Common Conncil or flre warden to remove or alter the same.
