County Agent To Determine If Jack Wall Was Delinquent

Probate Judge Jay G. Pray late yesterday authorized County Agent Arch D. Wilson to investigate the accidental slaying Friday of 12-year-old Barry Rothstein by Jack Wall, 11-year-old-son of Mr. and Mrs. Elbert R. Wall, 952 Greenwood Ave., to determine whether Jack was delinquent during the occurrence.

The Rothstein boy, a playmate of Jack, was the son of Mr. and Mrs. Samuel Rothstein, of Greenwood Ave., and was killed by a .32 caliber bullet discharged from a German Mauser pistol which was held in the Wall boy’s hand at the time. Jack explained to authorities that he aid not believe the gun was loaded, and could not remember squeezing the trigger.

Judge Pray indicated Wilson’s investigation will require two or three weeks, and if Wilson believes a hearing on the matter is necessary, he will ask Judge Pray to set a date for it. The petition for the investigation was signed by Detective Sgt. Eugene Gehringer.

The Wall boy’s father late yesterday paid a fine and costs of $53.35 in Municipal Judge Jay H. Payne’s court after pleading guilty to a charge of having in his home an unregistered pistol.
