High Court To Hear Appeal Dismissal Plea; Ypsilantians Involved

A State Supreme Court hearing on a motion by Prosecutor Edmond F. DeVine that appeals by four Ypsilanti residents, convicted on gambling conspiracy charges more than two years ago, be dismissed is scheduled to be held Tuesday in Lansing.

DeVine said, he has asked that the court order three of the four now free on bond pending outcome of the appeal, into custody. The fourth is now serving a prison term on another charge, he added.

Involved in the case are three men, Paul Wasson, 30, 504 First Ct., Marshall Taylor, 24, of 847 Jefferson Ave., and Harry Fuqua, 23, now in prison, and a woman, Abbey Clay, 36, of 335 Second Ave. Wasson, Taylor and Fuqua were given terms of 3 to 5 years in Southern Michigan Prison and the woman was sentenced to 2 to 5 years at the Detroit House of Correction. They were convicted March 13, 1952, on six counts of gambling conspiracy.

DeVine said Fugua is now serving a 47 months to 4-year term on a narcotics charge.

The prosecutor said he is asking that the appeal be dismissed because of lack of action by the four in completing their appeal. He noted that the court granted the four leave to appeal a year ago.
