At a session of the Probate Court for the County of Washtenaw. holden at the Probate Offlce in the City of Aon Arbor, on Tuesday, the 21st day of August, A. D. one thoueand eight hundred and ninety-four. Present, Hon.J. AJ'illard Babbitt, Judge of Probate. In the matter of the application of the Drain Commissioner of the County of Washtenaw, for the appointmeat ol three Special Commissioners to determine the necessity for a drain through certa.n lande in the townsbips of Lima and Sylvan, and for the taking of private property for the use and benefit of the public lor the purpose thereof, and the just compensation to be made therefor. Whereas, on the 2Ist iay of August, A. D. one thoueand eight hun. red and ninety-four, an application in wnuug was made to this Court by the Draai Commissioner of the County of Washtenaw, for the appointment of three Special Cummissioners to determine the necessity for a Drain through certain lagdsin the townships of Lima and Sylvan and described in said application, and for the taking of private property for the use and benefit of the public lor the purpose thereof, and the just compensation to be made therefor; And whereas, this Court did on the 21st day of August, A. D. one thousand eight hun dred and ninety-four, upon a due examination of suen application and of all the proceedings theretofore taken in the premises, iind the same to be in accordance with the statute in such cases made and provided, and did thereupon by an order entered therein, appoint the 25th day of September, A. Now, therefore, all such unkuown or nonresident persono, owners of the above des cribed lands, and each of them, are hereoy cited to be and appear beforc this Court, at the time and place last above set forth, to ae heard with respect to such application, if they bo desire, and show cause, if any there be, why the said application lor the appointmeiit of three Special Commissioners as aforesaid should not be granted. And it is further ordered, That the said Drain Commissioner give not'Ce of the penlency of said application, so far as it affects said lunds and the persons interested therein, y causlng a copy of this citation to be pubIshed in the Ann Arbor Argus, a weekly uewspaper published and circulating in the said County of Washtenaw. in whicli said county all of said lands are located, for ut east two weeks previous to said day of hearing.
