On Friday Jndge Carpenter, of Wayne county, ordered the deed set aside, the property transferred back to Mr. Westfall, and Capt. Allen appointed receiver to take oharge of the property. Mr. Wesfcfall will carry the case to the supreme court saying: "It is hard wheu you know ;hat yon are in no way to blame that snch a judgment shonld be rendered and as I have fonght it thus far I may as well go all the way.
