The court was occupiea til ay í ntraj and Satunlay forenoon willi the case of' Joel Haniilton v. Dr. Fiothiiiftham, to recover a claim tor alleged services In ¦Hing the Register property. Hamilton clairaed tliat the Dr. had offered liim the refial of the printing office with its stock and accounts for $8,000 in cash.and if he coulil sell it fur inore tha.i that he could liave the difference. As to the time this offer should remain open, the contestants differed, the ptatntiff claiminjr two weeks and the defendant several days, uiitil the Frlday nljrht of the week u which it was made. It appears that Hamilton corresponded with Mr. Kittredue about it, and upon bis coming: here introduced him to the Dr. After some time spent in makiug propositions, the partii's came to the tollowing arreement: The Register propeily should be sold tir$l 500 cash down, u mortgage of $3,500 to be given by Kittredpe andsome Minnesota property worth $,500. bilt subject to a mortffagé of $4,500, tlms making the sale at $9,000. Whereupon Hamilton went to Dr. Frulhitifiham wilh a claim ior $1,000, the aniount of the sale over $8,000. It was refused on tlieground that bis services had not been nquired in effecting the snle and tliat the time allowed him bad passed without his selling it. So suit was brougbt for $1,000. It was argtied by Kinne and Luwrence for the plaintlft, and by Knowlton and Wbitman for the defendant, and the jury brought in t verdict for $180, the recular agent's commission of 2% on the amount of sale. In his testimony Dr. Frothingham stated that be had lost $2,500 by the bargain, as the Minnesota property had been misrepresented to him, and really was not worth more tban $8.000 instead of $8,500. The case will be appealed by Dr. F-fothinghtm who deerns that Joe Hamilton forced his services on him agalnst bis wUli.
