Cider Comes Under The Local Option Law
Ia an opinión as to whether the manufacture and sale of eider ii included within the prohibitlon of the IockI option act, Edwin F. Conely, the well-known Detroit attorney, says that eider is uot a vinous liquor, neither is it malt or brewed. It muy, howeTer, becoine a fermented liquor, and when it reacties the point of beinjï intoxicHtinf it would come within the prohibition of the statute. Juet when eider may be considered fermented Mr. Conely snys, is a question of fact to be determined upon by the evidence. There is no doubt of the truth of the general proposition that eider may become an intoxic&ting liquor, and, as Rtich, comes under the the provisions of the local option act. Mr. Conely wishes it understood that in the above opinión he In no sense passes upon the constitutionMity of the act in question. He shnply wishes to be understood thnt if the act is valid, eider would come under lts prorisions when it reached the intoxicating stage. He further states that, as fcrmentiition in eider bejiins very shortly after it is made, the statute would apply atan eatly period of its exlstcnce.
