A great deal bas been saii of persons eonvicted of murdcr by mistake, butthe people of Johnstown, New York, think they llave a clearcase of á murderer acquitted by mistake. The man in question is Frederick Smitli, lately tried for the murder of Edward Yest and acquitted. The prosecution failed, tkrough inability to show that Smith ever had a revolver like the one with which the murder was committed ; but since the acquittal two witnesses havt! turned up who identify the weapon as one seeu in the possession of Smith, one of tiiem being a maihinist who inended it. Of course the murdorer canuot be tried again, and that is what annoys the people ; but as he is under arrest for arson they wi]l probably console tliemeelvüs by getting him convioted of that crime whether he is gnilty or üot.
