As the public Is interested in knowiug tbe provisioDS of law upon certain questions pertaining te railways, we publiin tbe following: FLAGMEN AT STREKT CBO88INGS. Whenever, in the opinión of the eommissioner of railways, the safety of the public would be more efflciently secure! by statiouing a flagman to signal trains where a highway or street is crossed by ny railroad, or by the building of a gate or bridge at such nighway or street crossing, he shall direct the Corporation owning or operating any such railroad to station a flagman, or to erect and maintain a bridge or gate at such crossing as the public safety may demaud ; and in case such flagman is directed to be stationed, or gate or bridge directed to be erected and maintained, any Corporation neglecting or refusing to construct and maintain such gate or bridge, or to maintain sucl flagman so directed as aforesaid, shal forfeit for every such.neglect or refusal the sum of $100 and the furtber sum o: $)0 for every day which such neglect or refusal shall continue.- G. R. R. L., Sec 17. FENCES, CATTLE GUABDS, KTC. Every railroad oompany formed unde this act or any former act, and every cor poration owning or operating any such railroad shall erect and maintain fencei on the sides of their respeetive roads o the height and strength of a divisioi ience required by law, with fences anc cattle guarda at all liighway and street crossings, sufficient to prevent cattle or otlier animáis from gettiiig on such railroad; also convenient farm crossings, and gates or bars thercfor; and every corporation owning or operating any such railroad shall within six months from the time any sec'Jon or portion of such road is finislied and put in general use by running regular trains thereon, erect or inaintain such fences or obstructions as aforesaid. Any violation of the provisions oí this section by auy railroad company owuing or operatini; such railway, shall be punished by a penalty of $2Ü0 per week lor each and every week that they shall fail to comply witli the provisions of this section. - G. K. R. L., Sec. 15 of article i. All railroads through enclosed lands that shall not be fenced as required by section 15 (being the above section) of this article, within the time therein required, shall not be operated through such enclosed lands without the consent, in writing, of the owner or occupant thereof. Upon complaint being made to the commissioner of railroads by any person owning or occupying such lands, that any railroad is being operated through the same, in violation of the provisions of this section, it shall be his duty to ascertain the facts in regard thereto, and if satisfied that such railroad is being so operated, he shall cause notice to be served upon the officers operating snch road, roquiringsuch fences and cattle guards to be constructed within sixty days from the date of 3uch notice. In case of fail- ure to fence the road within the time prescribed by such notice, he shall cause proceeding8 to be iustituted in the name of the people of the state of Michigan, by the prosecuting attorney of the proper county, to enjoin the uperation thereof until the fences and cattle guards are constructed.- G. R. R. L., Sec. 17 article 4. AIR BRAKES ON PASSENGER TRAIN9. On and after the thirty flrst day of Uctober eighteen-hundred and seventythree, on regular passenger trains shall be run in this state without an air brake or Sonie equally efftctive devise for checking the speed "of the train, to be approved bj the commissioner of railroads, which may be applied by the engineer to each passenger car composing the train ; and every railroad company, person, or Corporation owning or operating a railroad in this state, which shall permit any Buch trains to be run on such road without suck brake, hhall forfeit for every train so run the sum of filty dollars.ths; recovery of which, such company, person or Corporation shall be liable in an action on the case lo be brought in behalf of the peode of this state.- G. R. R. L., 8ec. 87. The Toledo road has been and still is running its passenger trains without air brakes.
