Sued In His Own Court
Lansing, Mlch., Feb. 1.- Rollin H. Person, circuit judge, has been sued in his own court, togelher with Colonel Frederick Schneider, for $10,000. Colonel ; Schneider rented a store building to j Georgf M. Dayton, dealer in Wholesale inilllnery, more than a year ago. Judge ■ Person gave him a lien on the stock for unpaid rent, and for a year or more during the pendency of legal proceedings the store remained ciosed. Recently Dayton made s. flank movement and removed the stock by night, but an order frcm Judge Person eompelled him to return it. After tendering the amount of rent he claimed to be due. and having it refused, he replevined the stock, and wa? proceeillng with the inventory when s peremptory injunction issued by Judge Person ,ordered all proceedings by virtue of the replevin to stop. For this reason Dayton has instituted his suit for damages, his bill alleging that the orders issued by Judge Person were invalid, and charging collusion and oppresslon on the part of Schneider and the court.
