Everything was ready Fnday for hearing the case of the city of Anu Arbor vs. Luther L. James, Edward Croarkin and Patrick Sloan, the case testing the "transient traders' ordinance" appealed November 19 fron Justice Duffy's court. M. J. Cavanaugh and A. J. Sawyer appeared for the plaintiff and Arthur Brown and J. F. Lawrence for the defendants. The jury was in Hs box and a large number of witnesses were on hand for both sides. The trial progressed slowlj'. Finally the defense moved 10 quash the case. In thé midst of the arguments which followed Judge Kinne took the case from the jury and issued an order for a verdict for the defense. He stated that while his sympathies were certainly in favor of some sueh protection íot the home merchant he could not but hold that the ordinance in qnestion was a direct discrimination between home and foreign merchants and that the licease is an unrea sonable tax, and for thes; Teasons contrary to the laws of the state of Michigan.
