            FILE AN ANSWER

When Hawks & Angus were constructing their tracks on Huron street the Ann Arbor railroad secured a temporary injunction to prevent them from crossing their tracks. The Detroit, Ypsilanti, Ann Arbor & J. railway has filed their answer to the Ann Arbor railroad's bill of complaint.

They deny that the grade on Huron street, from Main street, is a dangerous grade, and that operation of their cars will cause danger of collusion, and claim that the railway tracks can be constructed at grade with the steam railroad tracks, and by means of derailing and other safety devices, can be operated without loss of life and destruction of property, as set forth by the Ann Arbor road. The D., Y, A. A & J. also deny that they have applied to the railroad commissioner to permit the defendants to cross the tracks at grade.

They also allege that the franchise passed by the common council of Ann Arbor was a valid franchise

They set up that negotiations are in progress for a separation of grades a that point and that it will take some time to complete the separation, and until such time it will be a great detriment to the electric road and to the traveling public to prevent a crossing until the work is completed.
