Petition Filed to Oust Robert Hemphill

In Starkweather Case

Residuary Legatees Want the Estate Closed Up - Hearing is Jan. 24.

A petition signed by Mary A. Ladus, John R. Newberry, Walter A. Newberry, of Detroit, and John S. Newberry, of Romeo, has been filed in the probate court asking for the removal of Robert Hemphill as executor of the Mary Ann Starkweather estate and that somebody else be appointed.

The will was admitted to probate December 6, 1897, with Robert Hemphill as sole executor. 

In July, 1899, upon petition the circuit court judge put a construction upon the will.

On August 31, 1899, an inventory was filed showing that securities and property to the amount of $128,179.80 was in the hands of the executor and a year was given in which to settle up the estate.

On June 21, 1900, Executor Hemphill filed a petition asking for an extension of the time for one year and Judge Newkirk gave him until May 1, 1901, in which to close up the matters. Mr. Hemphill at that time claimed that there were about $10,000 of general legacies which were unpaid.

The petitioners in the present case are the residuary legatees and they want the general legacies paid up so that the residue of the estate may be divided among them.

For this reason they ask for Mr. Hemphill's removal.

The hearing on the petition will be given on Jan. 24. Attorneys Allen and Griffen of Ypsilanti are attorneys for Mr. Hemphill.
