Frank H. Esper, by Edward M. Vining, his attorney, has filed a petition for a writ of mandamus in the Wayne circuit court, in which he avers that the Detroit, Ypsilanti, Ann Arbor & Jackson Railway is entitled to charge only a cent and a half per mile for fares and should not charge more than five cents for a single passage between any two points from the township of Dearborn. He alleges that the company charges a five-cent fare for each township a passenger rides in or through, so that one is compelled, often, to pay ten cents for riding less than a mile. He asks that the company be ordered to charge a rate not to exceed 1 1/2 cents per mile from, to or in the township of Dearborn provided that not less than five cents be paid for a single trip. The company has been ordered to show cause on February 24.
