Last week The Register mentioned that a plank sidewiilk had been laid in the night in front of J. D. Stimson & Son's grocery stcre on Ann-st. It was done n the night probably to avoid City Marshal Sipley's eagle eye ; for a city ordinance passed June 21, 1884, reads as follows: Sec. 1. That all idewalks hereafter oonstructed, renewed, or relaid on either or both sidesof the folio wing streets, withn the followin limits, naroely : On Main st, from Liberty to Ann-sts, on Huron-st from Seeond to Fifth-st, and on Ann st from Main 8t to Fourth-st, shall be constructed of stone and laid pur suant to the ordinanoe of the city relative to paid sidewallts. The laying of this wood sidewalk seems therefore, a clear violation of the ordinance, for which a penalty is provided of a fine not lesa than $25 and not more than $75 and cot?, in defáult of payment of wbich the offender can be sent to jail not exceeding CO daya. The property in front of which this sidewslk was laid belongs to Dr. W. B. Smith, and the walk was laid by G. W. Orcutt. Last week the common council held a ha9ty session in the forenoon and instructed City Attorney King to prosecute Dr. Smith for this violation of the ordinance. Aceordingly proceedings were begun before Justice Frueauff on Tue8day last on complaint of the city marshal.
