At a session of the Probate Court for the Couuty of Washtenaw, holden at the Probate office in the city of Ann Arbor, on Monday, the third day of June in the year one theusand eight hundred and eighty-nine. Present, J. WILLARD BABBITT, Judge of Probate. In the matter of the estáte of Thomas S. Sanford, deceased. Benjamin Brown, executor of the last will and testament of said deceased, comes into court and represents that he is no prepared to render his annual account as such executor. Thereupon it is ordered, that Monday, the first day of July noxt.at ten o'clock in the forenoon be assigned for cxamining and allowing such account, and that the devisees, legatees, and heirs at law of said deceased, and all other persons interested in said estáte, are required to appear at a session of said Court, then to be holden at the Probate Office in the City of Ann Arbor, in said county, and show cause, íf any there be, why the said account should not be allowed : And it is further ordered, that eaid executor give notice to the persoDs lnterested in said estáte, of the pendency of said account, and the hearing thereof, by causing a copy of this order to be published in the Ann Arbor Register, a newspaper printed and circulated in said county, three successive weeks previous to said day of hearing. D. 1889, six months from that date were allowed for creditora to present their claims against the estáte of James H. Simonds, late of said county, deceased, and that all oreditors of said deceased are required to present their claims to said Probate Court, at the Probate Office in the city of Ann Arbor, for examination and allowance, on or before the fourth day of December next, and that such claims will be heard before said Court, on Wednesday the fourth day of September, and on Wednesday the fourth day of December next, at ten o'clock in the forenoon of each of said days. Whereas, default has been made in the conditions of a mortgage executed by Peleg Marshall to Helen Marshall, bearing date January 9th, A. D., 1874, and recorded in the office of Register of Deeds for Washtenaw County, Michigan, January lOth, 1874, in liber 49 of mortgages, on page 505, and where&s said mortgage contains the usual iusurance and tax lauses by which it is provided that any sums of money that said mortgagee may be obllged to pay to keep the buildings on the mortgaged premises insured against loss or damage by fire, and to pay any taxes assessed upon said mortgaged premises with ten per cent. interest thereon from the time of payment shall be a lien upon said mortgaged premises added to the araount secured bysaid mortgage, and whereas said mortgagee has been obliged to pay and has paid for such Insurance and taxes with such interest since the execution of said mortgage, the sum of thirteen hundred dollars ; and whereas by said default the power of sale contained in said mortgage has become operative, and no suit or proceeding in law or equity having been instituted to recover the debt secured by said mort. gage or any part thereof and the Bum of six thousand six hundred and seventyfour dollars, including the said sum paid for insurance and taxes and the interest thereon as aforesaid being now claimcd to be due upon said mortgage: Notice is therefore hereby given that said mortgage will be foreclosed by a sale of the moitgaged premises therein described or some part thereoito wit: All of the following described land situated in the City of Ann Arbor, in the County of Washteuaw, and State of Michigan, viz : the East half (Eli) Of lot No. eight (8) in block No. four (4), South of Huron Btreet in range No. six (6) East according to the original recorded plat of the village (now city) of Ann Arbor, excepting & piece of land one rod in width off from the West side of said lot, at public vendue on the fourth day of October next, at ten o'clock in the forenoon, at the Huron street entrance to the Court House in the city of Ann Arbor, in said County of Washtenaw, that being the place of holding the Circuit Court in said county.
