The county is now on the anxious seat in regard to the properly wliere thejsil i locaterf, and it ia not improbable that within a few days it will be necesaary to commence a suit to determine the rights o the paities, urless a coiupromise is af fected. When the present jail site wa3 purcbased, the committee having the matter in charge decided to purebase the lot on the cjruer of Second and Ann-sts, provided a right of way could be secured on both the south and east sides of the lot. This was amicably settled, as the committee supposed, and theground purchased, the deed specifying that the county should be entitled to a right of way, 1G feet wide, frotn Second-st to the alley in the rear of the opera house, off of the lot south of the one purchased. When the bara was built it was placed on the south-east corner, the entrance being on the south side by means of the right of way. Everything went along sraoothiy, me sheriff having undisputed use of this strip of land which is now a dispute, until Tuesday whea he notioed 8 workman diaging a trenoh, almost in frout of the ba"n door. Upon ir.quiry he found that A J. Siwyer, who js agent for theproperty had ordered a cësspool dug in front of the barn door, and in such a way that ït would prevent ingress or egresa from the barn. He told the workmau that he better not dig any more unless he wanted to get himself in trouble, and labor ceased until Wednesday, when it was commenced again and a large hole is the teault. Sheriff Dyer intormeü supervisor Case, one of the committee on public building, what was oiog on, and he hastened to the scène of action yesterday. It wasdecided to cali the committee toeether and unless some settlement was reached to take the necessary legal steps to secure the right of way. . Mr Siwyer states that the deed givea the couDty a right of way on the south line of the lot (half a dozen rods trom where it would be of any use to the c .unty,) while the Buperviaora are certain that the right of way is on the norlh line, where it would be ot' some use. Ia relation to the mat'.er, one ot tne supervisors said this morning, "This trouble comes beoause the board ot supervisors would not grant permission to tap the jail sewer 10 oarry away the water from the bath rooms. This digging is done inerely to forcé us into graoting this permission, which probably will not be doLO as the matter has very much the app earance of a bluff."
