James S. Schoonhoven, of Elgin, III., isnotasmucb. divorced as he thought he was on October 5 last, when he secnred a decree in the circuit court of this county. It will be remembered that heswore at that time that he was a resident of Ann Arbor, and that a few weeks afterwards it was proved by affidavits signed by Mr3. Schoonhoven and others that he was both a citizen and a voter in Elgin, 111. A petition was llled for a re-hearing of the case, and on Monday last Judge Kinne hstened to thearguments of the defendant's attorney. It was ordered that the decree rendered on the 5th of October be "set aside, reversed and held for nought, and it further appearing to the court, from the proofs subraitted with the defendant's petition, that both complainant and defendant reside without the state, and that the subject matter of the said bill of complaint arose without thie state, and that in granting said decretal order the court proceeded without jurisdiction of the parties to this canee, and t bat said decree was obtained by a frand practiced upon this court by the comDlainant, it is further ordered, adjudged and decreed that tbe bilĂ­ of complaint in the cause be and the same is hereby dismiased with cosls to be taxed, including the solicitor's fee of thirty dullarg, and that the defendant do have execution therefore." It appears that MrF.Schoonhoven.who is anattractive woman, is not averse to a separation, but she does object to being set aside, without receiving any part of her husband's respectable fortune. Mr. Schoonhoven, although the petition of the defendant was served upon him, made no appearance on Monday last.
