There was a greal deal of excitment n the circuit court room yesterday, afernoon, when Attorneys T. E. Barkworth and A. J. bawyer entered in a verbal combat. Mr. Sawyer certainly ound his match yesterday and suffered an amazing defeat, which, howtver, was not his fault, but rather his mislorune in being1 attorney for the cliënt he was fighting for. The case was T. E. ïarkvvorth. and Michael Brenner vs. Samuel Seney et al. , foreclosure. The fact of the case were these : The efendant had mortgaged his farm in jima to a Mr. Morrisoo, for $9,000. he mortgage died about two years ago and the mortgage was sold to T. E. Barkworth and M. Brenner, the plaintiffs, who brought suit of foreclosure. The case carne up in court about a week ago and a receipt of $3,000 igned by the original mortgagee was rodueed, and which the plaintiffs kncw nothing about. The case was hen postponed until yesterday. During the time intervening between a week ago and yesterday, frank Morison, the son of the original mortgagee, carne to Mr. Barkworth's office at ackson and said he had something on lis mind which he would like to disclose. Mr. Barkworth told him to ring Harvey Seney, who, he olaimed was implicated, and the matter would )e straightened out. Mr. Sawyer accused Mr, Barkworth yesterday of extorting information from the defendant by threats and bluff work. This kindled the wrath of Mr. Barkworth and he proceded 10 comb down the di - endant's attorney and asked to be sworn and relate his story of how he 'became aware of the information he had. Mr. Sawyer objected but the court allowed lim to be sworn and he related the story substantially as above stated. Also that Frank Morrison told him that the receipt of $3,000 was a fraud and that he had made it at Harvey Seney'a suggestion. The blank receipt he found with hisfather's signature and hemada out the rest of it. It was admitted in open court that the recipt was a fraud and that the witness had committed perjury.
