Ü!).- Ttaa grand jury bas tor several days been iuvestigating the charges against Gould and Sage of larceny of trust moneys in Pacific railway deals many years ago, aud on Tueslay went before Judge Cowing, and asked in eonnecuon with the complaint, ii the statute of limitations begias to run in relation to "withhoiding trust moneyi from the day when the crime of misappropriatioa was committed or from the timo of the discovery ot tbe f acts in the case?" Juilge L'owing said in reply: "The crime is undoubtedly a ielony, and therefore tho statute of litDÍcitioiiá oí fí.v yjari app'ieí. W henever there ia a frauduleut cad feiouious misappropriation, in my jud .'ment, tue statute of lunilations begins to run from that day. 80 b8lore you woald b9 permitted to indict any person under tbis stc joa of the law it wou id have to appear that the alleged misappropriation had taken place withinfiva years. There is one exception to that. If the eommittor of tho ofïense was without the urisdiction of the court it does nol begin to run until ha reaebes tbe jurisdiction oL the court. "
