ROTC Case Jury: 'guilty'
The only person arrested last September during a take-over of the University's ROTC building on the campus has been found guilty of illegal entryI and will be sentenced next February. David Sander, 19-year-old former U-M student living at 525 Walnut, had the guilty verdict turned against him by a District Court jury of four women and two men which deliberated about 30 minutes. Judge Pieter G. V. Thomassen set Feb. 13 for sentencing on the misdemeanor charge. Sandler is free on bond. Assistant County Prosecutor Jerome Farmer called four witnesses to the stand and Defense Counsel Daniel G. Bombery placed two witnesses on the stand. Ann Arbor Pólice Sgt. Marvin Konkle and Lt. Robert Whitaker testified they saw Sandler in the Museum Annex next to North Hall on N. University Ave. North Hall houses the ROTC quarters. The officers said at the time about 50 students. who had barricaded themselves inside North Hall had fled out a rear exit before arrests could be made. The officers said Sandler had locked himself in a women's rest room in the Museum Annex. Patrolman John Dailey testified he was boosted to a transom window where he saw Sandler, and Chief of University Security Rolland Gainsley testified the annex had been locked and secured prior to the discovery of Sandler inside.
Lawrence Soberman and Robert Leavy, called as defense witnesses, testified they were near North I Hall on the night of the take-over and saw persons entering and leaving the Museum Annex area.
